Update from the BEA to the BEA's Special Register of Silver Jewellers Members (Holders of a Precious Metals Jewellery Manufacturer's Code Number, which has expired on 31/12/2021).

Extension of the deadline for the renewal of the approval for the use of the metal stamp for the marking of jewellery made of precious metals until 30-06-2022.

Further to the informative letter 1318/22-06-2021, the BEA informs the members of its Special Register of Silversmiths.

Regarding the obligation to renew the authorisation to use a metal stamp to mark jewellery made of precious metals for the three-year period 2022-2024.

Based on the Rules for the Circulation and Marketing of Products and Services (I.E.P.P.S.Y. - Government Gazette 91354/2017, Government Gazette 2983B’, CHAPTER 6-SECTION 6.1, ARTICLES 53-59), this deadline for renewal expired on 31/12/2021.

According to the above mentioned I.E.P.P.Y.:

In the event of non-renewal of the authorisation to use the metal stamp, the stamp must be returned immediately by the holder to the Chamber.

At the expiration of the three-year deadline for renewal of code numbers, the Chamber is required to send to the Attorney General a list of names of those liable for renewal who have neither renewed nor delivered the seal to the Chamber.

The above list is also communicated to the relevant Regional Development Directorate. The latter shall check whether the stamp has been used after the expiry of the renewal period.

Renewal after the expiry of the time limit may be made by informing the competent authority.

Offenders shall be subject to a fine of two thousand euros (€2,000) imposed by the Region concerned, subject to Article 59. The fine shall relate to the failure to submit an application for approval or renewal, or to the use of an unapproved seal or to the use of a seal that should have been returned.

Stamps issued to importers or distributors (first distributors of products from EU member states) may not be used and must be returned to the Chamber by their holders (Article 55(7)).

Following the above, and if you have not renewed your metal jewellery marking stamp in time, we inform you of the following. The Administrative Committee of the BEA has decided (Decision No. 394.5/135/5/135/5/16-2-2O22). Before sending the relevant statement to the Prosecutor's Office, to give a new deadline of 30-6-2022 to settle this obligation, specifically:

Renew your metal stamp (if the business is active and the jewellery is made of precious metals). You must submit to the Chamber the following evidence of the manufacturing activity of your business:

The invoices for the purchase of precious metal (silver-gold) for the years 2018 -2021 or a Y.D. with a genuine signature that you are using stocks of metals from previous years.

Also sales invoices for the years 2018-2021.

The E3 form for 2017-2020.

Responsible Declaration for the machinery operating in the business.

Along with the submission of the above documents you must pay a fee of 10 Euros to the BEA's treasury. Also pay any outstanding dues to the Chamber.

Or you need to return the your metal stamp (if the business has ceased trading or changed its purpose). In addition to the metal stamp, submit to the Chamber the relevant change in the status of the business from the tax office.
